A misdemeanor conviction has a potential punishment of up to one year in county jail and a fine of up to $1000. Although a judge cannot sentence a person to prison on a misdemeanor, the consequences can affect a person's employment and/or residency if not a US citizen. Some misdemeanor offenses require a person to register as a sex offender, lose a driver license for up to a year, become unable to possess a firearm and/or loss of child custody. A person can be placed on probation from three to five years and be required to attend a program such as drug rehabilitation, anger management, parenting classes or domestic violence. Some of these programs can be expensive and last for over a year. There are a number of alternative sentencing options that will require a careful analysis of case facts, the relevant law and negotiations efforts. If negotiation is not an option, then a trial strategy is required with careful preparations that include witness preparations, field investigations and developing a trial plan that increases the chances of success.
